The Gujarat High Court has disposed of a petition regarding the allocation of parking space under a revised development plan of the Abhishek Heights Association apartment.
The association had petitioned against the Ahmedabad Municipal Corporation and Gujarat Housing Board, alleging that a revised development plan of the adjoining block had reduced their available parking area by 1,551.7 square metres. Further, the space designated for parking was obstructed by a Torrent Power transformer room, water tank and water room.
During proceedings before Justice Niral Mehta, government pleader GH Virk, acting on instructions from the Executive Engineer of GHB, clarified that the revised plan earmarks an exclusive 1,537 square metre parking area in compliance with GDCR norms. Crucially, he confirmed that this space is entirely separate from the transformer and water facilities cited in the petition.
Following this, the petitioner's counsel acknowledged that their concerns stood addressed and informed the court they did not wish to pursue the matter further. Justice Mehta accordingly disposed of the petition, closing the litigation.
