Jailed anti-CAA activist Umar Khalid has filed a review petition before the Supreme Court of India challenging its January 5 order that denied him bail in the Delhi pogrom "larger conspiracy" case under the Unlawful Activities (Prevention) Act, 1967.
The matter has been listed for hearing on Wednesday.
The earlier order was passed by a bench comprising Justices Aravind Kumar and N V Anjaria, which denied bail to Khalid and co-accused Sharjeel Imam.
The Court had observed that the prosecution's material disclosed a prima facie case, indicating their "central and formative role" in the alleged conspiracy, including involvement in planning, mobilisation and strategic direction beyond isolated incidents.
At the same time, the Court had granted bail to several other accused in the case, including Gulfisha Fatima, Meera Haider, Shifa Ur Rehman, Mohd. Saleem Khan and Shadab Ahmed. The January 5 order had also restricted Khalid and Imam, stating that they could renew their bail pleas only after the examination of protected witnesses or after one year from the date of the order.
The review petition was mentioned before the bench by senior advocate Kapil Sibal, appearing for Khalid, who requested that the matter be heard in open court.
"I wanted to make a mention, my request is, it is only for your consideration if you could have it in an open Court," Sibal submitted. Responding to the request, Justice Kumar said, "We will look into the paper, and if required, we will call it."
The development comes amid continuing legal proceedings in the larger conspiracy case linked to the 2020 Delhi riots, with the top court's review jurisdiction now being invoked to reconsider its earlier denial of bail.
