India's online gaming sector is entering a new phase, with a fresh regulatory framework now officially in place. The newly notified rules aim to bring clarity, safety, and structure to a rapidly growing digital space.

Designed to support the growth of e-sports and online social gaming, the framework also draws a firm line against real money gaming, which remains prohibited under the law.

When do the new rules take effect?

The rules will come into force on 1 May 2026. They put into action the Promotion and Regulation of Online Gaming (PROG) Act, 2025, which was passed by Parliament in August 2025. Together, the Act and the rules lay the foundation for how online games will be governed in India going forward.

Clear distinction between game types

A key goal of the rules is to clearly determine whether a game qualifies as an online money game, which is banned, or as a permitted social game or e-sport. To achieve this, the framework introduces a structured and time-bound process to classify games.

It also formally defines e-sports and certain categories of online social games, introduces user safety features, and sets out requirements for grievance redressal and transparency for service providers.

A 'light touch' approach to regulation

The government has described the framework as regulation-light. This means that most online social games will not require mandatory registration or prior classification before operating. The aim is to encourage innovation while still maintaining oversight.

Creation of a digital-first regulator

The rules establish a new regulator for the sector, functioning as an attached office under the Ministry of Electronics and Information Technology.

Its headquarters will be located in the National Capital Territory of Delhi.

This authority will be chaired by the Additional Secretary of MeitY and will include representatives from several ministries, including home affairs, finance, sports, law, and information and broadcasting.

What will the authority do?

The Online Gaming Authority of India will play a central role in enforcing the rules. Its responsibilities include maintaining and publishing a list of online money games, handling complaints, issuing directions and codes of practice, and coordinating with banks and law enforcement agencies to ensure compliance.

How are games classified?

The rules introduce an objective determination test to decide whether a game is an online money game. This process can begin in three ways: a review initiated by the authority on its own, an application from a service provider offering an e-sport, or when the government notifies a category of social games for evaluation.

The authority considers several factors, including whether players pay fees or deposit money, whether there is an expectation of monetary rewards, the platform's revenue model, and how in-game assets may be monetised outside the game. The process must be completed within 90 days of initiation.

Registration requirements explained

Registration is compulsory for anyone offering e-sports in India, as required under the Act. It is also needed for certain social games or categories that may be specifically notified by the central government.

These decisions may depend on factors such as potential risk to users, including children, the scale of participation, and the volume and value of financial transactions.

Another factor taken into account is the country of origin or the location of the service provider's head office.

Once approved, service providers receive a digital Certificate of Registration, which remains valid for up to 10 years. Importantly, online money games cannot be classified as e-sports under any circumstances.

Obligations for registered platforms

Registered service providers must prominently display their registration details, appoint a point of contact, follow data retention rules, and comply with directions related to payment systems.

Focus on user safety

To address concerns such as addiction and misuse, the rules introduce the concept of user safety features. These include technical, procedural, and behavioural safeguards designed to protect users from financial, psychological, social, security, and content-related risks.

Examples include age verification systems, time limits, parental controls, user reporting tools, grievance mechanisms, counselling support, and tools to ensure fair play and integrity.

Grievance redressal mechanism

All e-sport and online social gaming platforms must provide a grievance redressal system. If users are not satisfied with the outcome, they can escalate their complaint to the Online Gaming Authority of India within 30 days.

The authority aims to resolve such cases within another 30 days. A further appeal can be made to the appellate authority, which is the IT Secretary, who is expected to decide the matter within a similar timeframe.

Role of banks and financial institutions

Banks and financial institutions will play a crucial role in enforcing the rules. They must ensure that financial transactions are limited to legitimate and registered gaming platforms.

If they detect unusual or high-value transactions, they can request proof of registration from service providers. If a game is identified as a prohibited online money game, the authority can direct banks to suspend or stop all related financial transactions immediately.

Industry response and concerns

The e-sports industry has broadly welcomed the new framework, stating that it clearly recognises registered e-sports as a legitimate sporting activity. Many believe the rules will help prevent real money gaming platforms from presenting themselves as e-sports.

However, some concerns remain. Stakeholders have pointed out gaps such as the lack of clarity around financial systems for e-sports teams and players. There are also ongoing challenges in how banks distinguish between earnings from e-sports and those from real money gaming.
