In Pawan Kalyan's case, the issue has taken a political turn. YSR Congress and its supporters have raised allegations against the actor-politician. They claim he failed to keep promises and is hiding behind Personality Rights Protection.
The party argues that the legal move is aimed at avoiding Political Criticism. This narrative has been widely circulated on social media. However, legal experts strongly disagree with this view.
According to experts, Personality Rights Protection cannot shield anyone from political criticism. They state that such protection only applies to misuse of identity. It does not restrict public debate or political accountability.
Personality Rights Protection is meant to stop AI-generated morphs. These include fake images or videos that suggest a celebrity said or did something they never did. This legal safeguard prevents misleading content.
It also applies to fake social media accounts impersonating celebrities. Such accounts often post content without consent. The law protects individuals from this kind of impersonation.
Another key concern is commercial misuse. Some entities sell merchandise using celebrity names or images without permission. Personality Rights Protection prevents this form of exploitation.
Legally, Personality Rights Protection is an extension of privacy rights. It also overlaps with intellectual property protection. However, it does not block constructive criticism.
Defamatory trolling is restricted under this protection. Legitimate political criticism remains untouched. Therefore, claims that Pawan Kalyan is using this law to avoid criticism are incorrect.
Recently, Pawan Kalyan sent legal notices to several e-commerce platforms. He asked them to remove merchandise using his name and pictures without consent. Some platforms complied, while others did not.
During the hearing, the Delhi High Court ordered removal of such content within seven days. The next hearing of the matter is scheduled for December 22nd.
