The Bombay High Court, in a historic ruling, recently overturned a 2021 decision of Margao Trail Court. The High Court clarified that a woman entering a hotel room in no circumstance guarantees her consent for sexual intercourse.
The original case revolved around a 2020 incident where a man by the name of Gulsher Ahmed allegedly lured a woman into a hotel room, in pretense of offering her a job.

He then reportedly threatened and raped her in that room. The victim managed to flee the scene, immediately reporting Gulsher Ahmed to the police, leading to his arrest.
The Margao Trial Court acquitted the accused in 2021, since the victim was involved in booking the hotel room, she had automatically consented to the sexual activities that took place there.

Justice Bharat Deshpande, presiding over the case in Bombay High Court, pointed out the error in judgment of the Trial Court, stating that the mere presence of a woman in a room does not mean her consent to sexual relationship.
The decision of the Trial Court was overturned, much to the relief of the victim and her family.
