The Department of Industries, Energy, Labour and Mining, Government of Maharashtra has released the draft State Rules under three of the four Labour Codes for public consultation.

These draft rules will play a crucial role in determining how the Labour Codes are implemented in practice and will have a direct bearing on compliance obligations for employers across sectors.

The proposed rules cover several issues of significant importance to the industry. These include the treatment of wage components and allowances under the Code on Wages, provisions relating to working hours, spread-over and overtime under the occupational safety framework, and, importantly, social security obligations for aggregators and digital platforms with respect to gig and platform workers under the Code on Social Security.

While the Labour Codes establish the broad legislative framework, the rules define the operational details that businesses will ultimately need to comply with. We invite members to carefully review the attached draft rules and share their comments, concerns, and recommendations by June 5, 2025.
