Delhi HC restrains Priya Kapur from managing late Sunjay Kapur's immovable assets

Advocate Ravi Sharma, representing Karisma Kapoor, announced on Thursday that the Delhi High Court has granted an interim injunction in favour of Karisma Kapoor's children, restraining Priya Kapur, widow of the late Sunjay Kapur, from dealing with his immovable properties, companies, shares, bank accounts, and cryptocurrency wallets.

Sharma stated, “The court today has granted an injunction in favour of Karisma’s children, whereby it has injuncted Priya Kapur from dealing in any manner with the immobile assets of Sunjay Kapur. The Court has specifically said that Priya Kapur can not deal with any of the immobile properties, companies, shares, bank accounts and crypto wallets of Sunjay Kapur…Priya has the obligation to dispel the suspicious circumstances which were cited and which seem reasonable as pleaded by Karisma’s children.”

Meghna Mishra, counsel for Priya Sachdev Kapur, described the court order as balanced, noting, “It seems to be a very balanced order where she has said that the status quo of the assets should be maintained, certain personal assets will be, which is something that was willingly also already offered by Ms Priya Kapur during the course of the arguments. The court has also held that it does not have jurisdiction over the foreign assets. It is a balanced order which has been pronounced.”

The Delhi High Court passed the order following an interim injunction plea filed by Karisma Kapoor’s children, restricting the creation of third-party rights over Sunjay Kapur’s assets. The court also directed the submission of account statements and prohibited operation of foreign bank accounts and cryptocurrency holdings.

Observing that the petitioners and Defendant 3 (Rani Kapur) raised “suspicious circumstances,” the court held that the onus is on Priya Kapur (Defendant 1) to dispel such doubts. The court further ruled that preserving the estate is necessary as the trial may take time and the assets must be protected in the meantime. Additionally, the court stated that all legitimate concerns raised by the petitioners must be addressed by Priya Kapur.

This order comes amid a high-profile dispute involving the estate of the late industrialist Sunjay Kapur. The Delhi High Court had previously reserved its verdict on interim applications after concluding hearings. The injunction plea was filed by Kapur’s children from his earlier marriage to actor Karisma Kapoor, who have challenged the authenticity of the Will.

Senior Advocate Rajiv Nayar, representing Priya Kapur, rejected allegations of asset concealment or siphoning and maintained that full disclosures have been made. He also defended the validity of the Will, stating it follows a format similar to another family Will.

Opposing this, Senior Advocate Mahesh Jethmalani, representing the children, highlighted alleged inconsistencies in the Will, including its language, lack of registration, and challenged the circumstances of its preparation. He argued that heightened scrutiny is required because Priya Kapur is both the propounder and sole beneficiary.

Separately, Sunjay Kapur’s mother has also contested the Will, claiming she was unaware of its existence and questioned the extent of asset disclosures.

The ongoing dispute involves assets estimated to be nearly Rs 30,000 crore. The High Court’s interim order now ensures the preservation of the estate pending trial.
