Delhi High Court issues notice on bail plea of POCSO accused Seema Rani Khakha

The Delhi High Court on Thursday issued a notice to the Delhi Police regarding the bail application of Seema Rani Khakha, who is accused in a case registered under the Protection of Children from Sexual Offences (POCSO) Act.

The case was heard by Justice Swarana Kanta Sharma, who sought a response from the Delhi Police and scheduled the matter for further hearing in May. This direction came during Khakha’s challenge against the trial court’s refusal of her third bail application.

The bail petition, filed through advocate Rahul Kumar, stated that the trial court had rejected her third bail request on February 12, 2026. Khakha is now seeking relief from the High Court, contending that she should be granted regular bail on account of being in custody for 2 years and 9 months.

Her plea argued that as per the Supreme Court’s order, the trial should be expedited, but so far only the victim has been examined. The petition also noted that during the victim’s cross-examination, the victim significantly changed her prior statement and gave contradictory testimony.

Seema Rani Khakha is accused alongside her husband, Premoday Khakha, who served as Deputy Director in the Delhi Government at the time of the alleged incident. The case involves serious allegations concerning a minor victim.

The prosecution stated that an FIR was registered by the Delhi Police on August 13, 2023, after a hospital lodged a complaint alleging sexual assault of a minor girl. Following registration, the police commenced an investigation that resulted in Khakha’s arrest.

She was remanded to judicial custody on August 21, 2023, where she has remained since. The allegations assert that her husband sexually assaulted the minor, resulting in pregnancy. It is further alleged that Khakha administered pills to the minor to terminate the pregnancy. These accusations are central to the prosecution’s case against her.

A chargesheet has already been filed by the investigating agency, and the trial is now at the stage of prosecution evidence before the trial court.
