The Delhi High Court has issued a notice to the Central Bureau of Investigation (CBI) regarding an application filed by Sarvesh Mishra, an accused in the Delhi Excise Policy Prevention of Money Laundering Act (PMLA) case, seeking the resumption of proceedings in the money laundering case.
Justice Swarana Kanta Sharma directed the CBI to file its response, with the matter scheduled for hearing on May 4.
Advocates Farrukh Khan and Aditya Tyagi appeared on behalf of Sarvesh Mishra.
Mishra filed the application requesting the court to vacate the interim ruling dated March 9, by which the PMLA Court was asked to defer proceedings pending the decision on a revision petition.
During the hearing via video conference, the counsel emphasised that Mishra is not an accused in the predicate CBI case but is involved only in proceedings initiated by the Directorate of Enforcement (ED) under the PMLA.
“Despite this, the interim direction passed without notice or hearing to him has the effect of stalling proceedings before the PMLA Court, thereby directly and adversely impacting his rights,” the counsel submitted.
The application also noted that the said interim direction remains in effect despite the discharge of all accused in the predicate offence.
The trial court had discharged all accused, including Arvind Kejriwal and others, in the CBI case connected to the Delhi Excise Policy case. An appeal against the discharge order is currently pending before the Delhi High Court.
