Delhi High Court orders takedown of content infringing Allu Arjun's personality rights

The Delhi High Court has issued an ex parte ad interim injunction protecting actor Allu Arjun's personality rights and prohibiting unauthorised use of his name, image, voice, likeness and distinctive attributes across both physical and digital platforms.

Justice Tushar Rao Gedela granted the injunction after finding a strong prima facie case in favour of the actor, observing that the balance of convenience lies with him and that irreparable harm would result without immediate protection.

The court restrained multiple defendants from using or misappropriating Allu Arjun's identity or associated attributes for commercial or personal gain. This includes prohibitions against exploitation through emerging technologies such as artificial intelligence, deepfakes and voice cloning.

Defendants are also forbidden from violating the actor's moral rights by commercialising his performances via technological means. The sale or advertisement of goods and services under his name or registered trademarks - including merchandise like clothing, posters, mugs and digital content - is also barred without authorisation.

Significantly, the court directed certain intermediaries to remove all infringing links and websites identified by the plaintiff within 72 hours and allowed the actor to report further infringing content in the future, which must be promptly blocked upon notification. The plaintiff is permitted to implead new infringers and seek extension of the injunction against them.

The judgment noted Allu Arjun's extensive goodwill and reputation accumulated over decades, supported by documentary evidence including his career achievements, awards, endorsements, and trademark registrations. It affirmed that his name, likeness, voice, gestures and other personality traits are distinctive identifiers entitled to legal protection.

The court heard the plea filed by the actor to safeguard his personality rights from unauthorised commercial exploitation, including AI-generated content and online merchandise.

At the outset, the court examined questions of territorial jurisdiction due to the actor's connection with Telangana. Counsel for Allu Arjun argued that the alleged violations occurred across digital platforms nationwide, warranting the Delhi court's jurisdiction.

Senior Advocate Swathi Sukumar, representing the actor, highlighted the rising misuse of celebrity identities through technology, including applications featuring AI-generated versions of the actor, calling the situation “truly frightening” and stressing the need for urgent judicial intervention.

Meanwhile, counsel for intermediaries opposed a global injunction, noting that related matters are under consideration by a Division Bench. The court thus limited its directions to specific infringing content but indicated further orders may follow.

The Delhi High Court has issued summons in the suit and scheduled the matter before the Joint Registrar for completion of pleadings. The case will be next heard on September 24, 2026.
