Supreme Court upholds bail for Arunachal Pradesh IAS officer in suicide abetment case

Itanagar: The Supreme Court on Thursday overturned the Gauhati High Court's decision cancelling the bail of Arunachal Pradesh IAS officer Talo Potom in connection with an abetment of suicide case linked to the death of 19-year-old Gomchu Yekar.

A Bench comprising Justices J.K. Maheshwari and Atul S. Chandurkar allowed Potom's appeal after hearing submissions from the complainant's counsel and held that there were no valid grounds to revoke the bail earlier granted by the trial court.

The apex court ordered that the bail granted by the trial court would remain effective.

However, it directed Potom not to threaten, influence or intimidate the complainant or witnesses during the course of the trial, warning that any such attempt could result in cancellation of bail.

The Court refrained from making any observations on the alleged dying declaration to ensure that the merits of the case remain unaffected.

The matter pertains to the death of Gomchu Yekar, whose body was discovered at a rented house in Lekhi village on October 23, 2025.

Investigators had claimed that suicide notes recovered from the spot accused the individuals named in the case of mental harassment, sexual exploitation, involvement in corruption-related activities and exposing the deceased to HIV/AIDS.

Potom was arrested on October 27, 2025, and secured bail from the Sessions Court within a week. The deceased's father later challenged the order, following which the Gauhati High Court cancelled the bail and directed that Potom be taken into custody.

While cancelling the bail, the High Court had stated that the trial court failed to properly examine the available evidence and had overlooked important material, including references to Potom in the alleged suicide note.

The court had also taken note of the prosecution's claims regarding the deletion of WhatsApp chats and voice recordings, which were later sent for forensic analysis.

The High Court further expressed concern that releasing an "influential person" at an early stage of the investigation could hamper the probe.

Potom subsequently approached the Supreme Court, challenging the High Court's order. Restoring the bail, the apex court clarified that its observations were confined only to the issue of custody and would not have any bearing on the trial proceedings.
