A Delhi court has issued a notice to Assam Chief Minister Himanta Biswa Sarma in connection with a plea seeking the registration of an FIR over his alleged controversial remarks about 'Miya Muslims'.
The case has been filed by activist Harsh Mander, who has accused the Assam Chief Minister of making provocative statements during a public event in Assam. The court action came while hearing a revision petition filed by Mander, who is challenging an earlier decision of a lower court that had refused to order the filing of an FIR.
The order was passed by Additional Sessions Judge Sonu Agnihotri on May 26. The court said it would proceed after receiving a response from the concerned parties and listed the matter for further hearing on July 15, 2026.
Mander had earlier approached a magistrate court seeking action against Sarma over remarks made during an event held in Digboi in Assam’s Tinsukia district on January 27. He alleged that the Chief Minister had made statements targeting “Miya Muslims” and referred to the removal of “four to five lakh Miya voters” during the Special Intensive Revision of electoral rolls in Assam.
The plea also claimed that Sarma’s comments encouraged hostility against the community and included statements suggesting that people would leave Assam only if they faced difficulties, and that efforts were being made to ensure they could not vote in the state.
However, the magistrate's court had earlier rejected the request to register an FIR, citing a lack of jurisdiction. This order has now been challenged before the sessions court.
During the hearing, Mander’s legal team argued that police can receive information about a cognisable offence at any station, regardless of where it was committed, referring to guidelines on filing Zero FIRs issued by the Ministry of Home Affairs.
The court took note of the arguments and issued notice on the revision petition, asking for a response from the other side before the next hearing.
The matter will now be heard again on July 15.
