Incomplete facilities, poor construction,safety flaws flagged
Maharashtra Real Estate Regulatory Authority (MahaRERA) has delivered a strong order against the Aswani Group (Aswani Paradise) , a prominent builder in Pimpri-Chinchwad , after serious complaints about incomplete facilities and poor construction at its Wakad housing project, Aswani Galaxy.
The case was filed in April 2025 by Omprakash Jangir and Manisha Jangir, initially as an individual complaint but later converted into a group complaint following a society resolution. The residents alleged that the mechanical parking system remained incomplete, construction defects and seepage persisted, fire safety arrangements were inadequate, and unauthorised parking allocations were blocking emergency access.
Taking these issues seriously, MahaRERA acknowledged the lapses and directed the promoter to rectify all deficiencies within 60 days. The order mandates completion and activation of the mechanical parking system, removal of construction defects, operational fire safety systems, and clearance of unauthorised parking to ensure emergency vehicle access.
MahaRERA has further warned that failure to comply will invite legal action under RERA provisions against the promoter of Aswani Paradise. The ruling marks a significant victory for residents, highlighting how regulatory intervention can hold builders accountable for negligence and safeguard homebuyers' rights. Omprakash Jangir, complainant and resident, Aswani Galaxy, Wakad said, "The builder failed to complete essential facilities, rectify serious defects and ensure basic safety. Despite repeated follow-ups and even a two-year extension under RERA, no progress was made. Completion Certificate, Occupancy Certificate and other mandatory NOCs were not obtained. We had no choice but to approach RERA. This order proves our complaints were valid. Now we expect immediate completion, accountability and necessary improvements. If not, we will pursue further legal action."
Shrichand Aswani, builder, said, "This housing project was handed over to the society four years ago. Facilities were provided from time to time. After that, we have no connection with the project. Hence, the question of providing facilities does not arise."
MahaRERA grants 60-day deadline
Residents of Aswani Galaxy had raised serious concerns: an incomplete mechanical parking system, construction defects, seepage, inadequate fire safety and unauthorised parking blocking emergency access. MahaRERA acknowledged these lapses and issued binding directions.
The promoter must complete and activate the mechanical parking system, rectify all construction defects, make fire safety systems operational and remove unauthorised parking to ensure emergency vehicle access within 60 days. MahaRERA has warned that failure to comply will invite legal action under RERA provisions against the promoter.
The order has intensified the dispute between residents and the builder, with residents demanding accountability and builders denying responsibility. The regulator's intervention has now placed the onus squarely on the promoter to deliver long-pending facilities and ensure safety compliance.
