Gathering a Mob in a House Under the Guise of 'Namaz-Pathan' is Inappropriate

Prayagraj/Allahabad (Uttar Pradesh) - Gathering people on a large scale at a private property for reciting 'Namaz' is not appropriate, opined Allahabad High Court in a case of public 'Namaz' recitation at Bareilly. The Court objected to the practice of such collective 'Namaz' recitation on a private property and instructed to stop it. The Court also gave freedom to the local administration to take action in case of a likelihood of unrest.

1. The Court noted that law and order and peace cannot be staked making use of personal security and private property.

2. Tariq Khan, a resident of Bareilly had filed a petition against the ban imposed on 'Namaz' recitation on private properties during Ramzan and action taken in a case violating peace.

3. An Additional Advocate General Anoop Trivedi informed the Court on behalf of the Government that the petitioner was violating the rules giving the excuse of security. As per the affidavit and proof presented by the petitioner, 50-60 people were gathering on his private property every day for recitation of 'Namaz', causing danger to the security and communal peace in the area.

4. It is the main duty of the administration to maintain law and order and such practices causing disturbance to communal peace cannot be allowed, clarified the Court.

5. The District Administration and Police will be free to take action if mob is gathered in the area again under the guise of 'Namaz' recitation and disturbance is caused.
