The Delhi High Court on Thursday ruled that booth level agents of political parties cannot be held liable for false details in enumeration forms that cannot be verified during the Special Intensive Revision of electoral rolls. Justice Amit Bansal said booth level agents (BLAs) are liable only for verifiable information like the elector's photograph.

<nh-chunk-delimit />&quot;In the opinion of this court, BLA can only be made liable in terms of Section 31 of the Representation of People Act for information that can be verified by the BLA, i.e., the photograph on the enumeration form matches with the identity of the elector,&quot; the judge said. Section 31 states that making false declarations with respect to the preparation, revision or correction of an electoral roll is punishable with imprisonment for a term which may extend to one year, or with fine, or with both. The judge passed the judgement on a petition by the Delhi Pradesh Congress Committee (DPCC) president Devender Yadav and the chairman of the DPCC's booth management committee. The petitioners challenged the mandate requiring BLAs of political parties to give a personal undertaking certifying they have personally verified all details in the enumeration forms. It was argued that since the information to be filled in the enumeration form is within the elector's exclusive knowledge and the BLA's role is limited to providing assistance, he could not be made to personally authenticate all such details. The Election Commission of India (ECI) informed the court that it permitted all registered political parties to appoint their own BLAs to participate in the process of SIR to dispel any impression of supporters of any specific party being deliberately left out by the booth level officers (BLOs) in a partisan manner. The requirement of BLAs furnishing undertaking while submitting applications and forms on behalf of the electors was part of ECI's standing instructions and the Manual of Electoral Rolls, 2023, it stated. In the judgement, the court observed that under the SIR framework, the responsibility for verification and undertaking rested with the BLOs, and therefore, there was no justification for requiring BLAs to furnish personal undertakings certifying the correctness of the particulars in the enumeration form. It added that although BLAs would have full responsibility for the forms of dead or shifted voters, as they are filled by them based on information gathered by them, they cannot be held liable for all the unverifiable information pertaining to other electors. &quot;The BLA cannot be made liable for all the information, which is contained in the Enumeration Form as there is no way a BLA could be in a position to verify the same. The said information would be exclusively within the knowledge of the concerned elector,&quot; the court said. The court also said that the copies of 2002 electoral roll and the final 2025 roll was available on the ECI website and can be downloaded or physically sought from the ECI. The petitioners would be free to apply for physical copies of the electoral rolls up till May 2026, based on which the SIR is being conducted, and subject to payment of requisite fees, the same would be supplied to the petitioners, it added. Senior advocate Sakal Bhushan, along with lawyers Sunil Kumar, Vasu Bhushan, Prateek Kumar Sinha and Nipun Bhushan appeared for the petitioner. According to the petitioner, neither the Representation of the People Act nor the Registration of Electors Rules contain any provision empowering the Election Commission to ask the representatives of political parties to give such an undertaking. &quot;The requirement of a personal undertaking from BLAs is directly contrary to the statutory scheme of verification prescribed under Section 23 of the Representation of the People Act, 1950, which mandates that the inclusion of any name in the electoral roll shall be made by the Electoral Registration Officer, and only after 'proper verification of facts in such manner as may be prescribed',&quot; the petition had said. &quot;The prescribed manner of verification under the Rules is to be conducted by statutory officers, not by private individuals or party representatives. The imposition of an undertaking of personal verification upon BLAs amounts to an unlawful delegation of a statutory function to private actors,&quot; it added. Chandigarh, Sep 3 (PTI) The rights of all eligible voters will be fully safeguarded during the ongoing Special Intensive Revision (SIR) of electoral rolls, Haryana's Chief Electoral Officer A Sreenivas said on Thursday, allaying apprehensions regarding the required documents and old electoral records.

<nh-chunk-delimit /> According to an official statement, concerns were raised over the possibility of names being deleted from the electoral roll due to discrepancies found during matching and failure to match with the electoral roll of the previous Special Intensive Revision. Following this, Srinivas clarified that the names of eligible voters cannot be deleted from the electoral roll merely on the non-availability of old voter records and related documents. During the SIR process, a voter's eligibility will be examined based on the available documents and rules prescribed by the Election Commission of India, he said. The objective of SIR is not to delete the name of any eligible voter from the electoral roll without following due process. The purpose of this process is to make the electoral roll more accurate, updated and error-free, Sreenivas added. As per the directions of the Election Commission, voters whose details do not match the electoral roll of the previous intensive revision will have to submit the required documents, based on their date of birth, as evidence of their eligibility. Srinivas appealed to all eligible voters to ensure that they check their names in the draft electoral roll. &quot;If the name is not included, Form-6, and in case of any error, Form-8, should be submitted to the concerned Electoral Registration Officer (ERO) or Booth Level Officer (BLO) by September 30, so that the name of every eligible voter can be included in the final electoral roll,&quot; he said in a statement. &quot;So far, 1,36,646 Form-6, 10,156 Form-7 and 1,06,671 Form-8 have been received,&quot; he added. Mostly, the SIR process will be extended by three weeks, with final electoral roll publication scheduled for the last week of November,” sources said.As per the current schedule, claims and objections on the draft electoral roll can be filed up to September 16, while the notice phase and disposal of claims and objections will continue up to October 15. The final electoral roll publication is scheduled for October 19.In a letter to the Chief Election Commissioner of India Gyanesh Kumar, Chief Minister A Revanth Reddy had said a one-month window for claims and objections would not suffice and sought an extension by four weeks. In addition, he sought three to four weeks for each elector who was served a notice to reply and produce papers.Meanwhile, Telangana CEO C Sudarshan Reddy directed officials to speed up the process of hearing and disposing of notices issued as part of the SIR of electoral rolls, with the aim of ensuring an accurate voter list.Sudarshan Reddy, along with Additional Chief Electoral Officer Vasam Venkateshwar Reddy and Medchal district collector M Manu Choudary, inspected the hearings conducted in Narsampally of Keesara Mandal, Munirabad of Medchal Mandal, and Dommara Pochampally of Dundigal Mandal on Thursday.He instructed officials to properly verify records and applications related to voters who have not been mapped and those falling under the categories of discrepancies (anomalies) in voter cards. Kolkata: Before the third phase of the Election Commission's Special Intensive Revision (SIR) of voter rolls, Delhi had 1,45,10,299 registered voters.

<nh-chunk-delimit /> By August 17, Booth Level Officers (BLOs) working house to house had collected forms from 97,53,577 of them. The rest, 47,56,722 names, did not appear on the draft roll published two weeks later.That's nearly a third of the city's electorate. The Wire has found that the 47.56 lakh names deleted from the list are predominantly working-age men in transient or informal housing, disproportionately migrant workers from Poorvanchal and, on every demographic marker available, blue collar job seekers rather than the settled middle class. This is borne out by testing the data with sex ratio numbers, the age profile, the categories and the surnames.&sect;The Election Commission of India (ECI) has released the Absent, Shifted, Duplicate and Deceased (ASDD) list for all 14,947 booths across 70 assembly constituencies. Each name comes with an EPIC number, a relation type and relation name, the position the person held on the previous roll, their exact age, their sex, and one of four reasons an officer entered against them.To analyse the exercise, The Wire downloaded all 14,947 documents and categorised them. The documents give each person's exact age, so the 31 to 60 bracket used throughout this piece comes from there. The surname figures come from counting how often each name appears.More men off the listTaking an average across all 70 assembly constituencies, 56.78% of the names removed from the list are men, against 43.21% women. The overall sex ratios of the voter list make this even clearer: Delhi's roll had 882 women for every 1,000 men when the exercise began. In the SIR, 747 women were deleted for every 1,000 men deleted. In Okhla, 63.68% of the removals were men. In Tughlakabad 61.71%, Moti Nagar 61.51%, and Sangam Vihar, 60.91%.For anyone familiar with Delhi's urban informal economy, this is perhaps not a surprise. The city's migrant workforce is overwhelmingly male. Blue-collar job seekers come to the city alone and register at a transient address, a rented room or a bed at a work site, while the family stays in the home state. When the work moves on, a voter registration might be left behind at an address nobody can confirm.Looking at this through the lens of the age profile, between 61% and 75% of removals in any given constituency fall in the 31 to 60 years bracket. Overall, 68.72% of names removed fall within this (working) age range. Deaths account for only 5.94% of the total removals. These numbers suggest it is the working population, not those who died, who are largely being 'cleaned' off this list. 91% deletions based on officer not being able to find someoneEvery removal carries one of four reasons, entered by the officer against each name on the booth's list. Two reasons dominate.The first is 'Permanently shifted' accounts for 31,59,223 people, a little over 3.15 million, or 66.42% of the total. The second most common reason is 'Untraceable or absent'which accounts for another 11,73,552, which is 24.67%. Together, those cover 91.09% of the deletions. Deaths, as we discussed above, account for 5.94%, and duplicate registrations 2.98%.Those with rented accommodation, a large category in a city of migrants like Delhi, are the largest victims of the removals.Interestingly, in the high-volume, migrant-heavy seats, the same three surnames come up every time. In Burari, 10.12% of the removals have the surname 'Kumar', 9.56% are 'Devi', and 7.54% are 'Singh'. Narela gives the same three surnames in top deletions, in the same order. Across the city, the surnames Kumar, Devi and Singh alone account for 21% of the total removals.So far, this looks like a straightforward story about poor migrant workers living in rented rooms, often temporarily, who have been removed from the voter rolls. Much of the coverage too has framed the matter in this way. Ranking the deletions by the numbers, the worst-hit seats are outer Delhi's big working-class constituencies. Burari lost 1,67,885 voters, more than anywhere else. Okhla lost 1,63,829, Badarpur 1,46,673 and Vikaspuri 1,46,225.But a constituency's total number of voters indicates how big it is - and deletions as a proportion of the constituency's voters paint a different picture. The five biggest seats by booth count lost 1.32 lakh voters on average. The five smallest seats by booth count, lost 42,000. Burari has 409 booths and lost 1,67,885 names. Delhi Cantonment, which lost the fewest voters of any seat at 22,855, has only 94.If we rank the constituencies by average number of voters deleted per booth, this is what it looks like: Delhi averaged 318 removals per booth. Okhla tops the list at 475, Badarpur at 449, Kalkaji and Patparganj at 440. Burari drops from the first to sixth rank. Rohini comes last at 135.Okhla, Badarpur and Tughlakabad are seats which show the maximum numbers of deletions. Both as percentages knocked out and by real numbers. R.K. Puram lost 44.4% of its roll, a larger share than all but two seats in Delhi. Most of the area comprises government staff quarters. New Delhi lost 41.6%, Jangpura 41.4% and Delhi Cantonment 35.4%.Those are among the wealthiest constituencies in India, and all four are dominated by temporary addresses rather than permanent, being government housing, army housing and the South Delhi rental belt. They lost small absolute numbers because they are small seats.Meanwhile Rohini lost 16.5% and Rajouri Garden 20.9%, the two lowest rates in west Delhi. Both are comfortably off and owner-occupied.Some of the poorest parts of the city saw the least percentages of names deleted. Mangolpuri lost 21.2%, Seelampur lost 23.3% and Babarpur 27.0%. These areas are dense, working class, and settled long enough that people own residences they occupy.Tenant versus owner?Delhi is the rare city where this distinction can be tested, because ownership here doesn't track wealth. The poor often own, through resettlement colonies allotted in the 1970s and '80s, plots bought in unauthorised colonies, and 'lal dora' village land. The more affluent often rent, because the centre and the south run on government quarters and the rental market. One caveat before the numbers. Nobody publishes ownership rates by assembly constituency in Delhi, so the housing labels used in this piece were assigned seat by seat from what is known about the city's residential geography. They are judgment, not measurement.The income side can be checked against official estimates - and it has been. MCD assigns every colony in Delhi a property tax category from A to H, with A being the most valuable, and the published list covers 2,638 colonies across 249 wards. Fifty-one of the 70 constituencies share their name with an MCD ward, which allows a comparison.Studying the data in this way, it becomes clear that while both colony value and number of renters can explain the number of voter deletions each seat saw, with number of renters doing the heavy lifting. Constituencies that are renter-heavy saw a higher number of deletions, across income categories.The Wire sorted Delhi's 70 seats two ways at once, by housing and by income, to see which of the two is actually driving the removals.Sixty-one percent of the poorer constituencies are mostly owner-occupied, against 33% of the richer ones.Even if you look at the data mindful of their respective incomes, renters still remain far more likely to be deleted from the city's voter rolls. About the data.The ECI published the ASDD list as 14,947 separate booth-wise documents, one per polling booth. Each names the individual electors whose enumeration forms were not received and gives, for every name, an EPIC number, a relation type and relation name, the position held on the previous roll, age, gender, and one of four uncollectable reasons. Figures here come from parsing all of those documents and aggregating them, and the result reconciles exactly with the Chief Electoral Officer's press note on booth count and all four category totals. Margins come from the February 2025 assembly results.Housing and income categories are not in the published data. There is no ownership percentage behind them and no threshold, because no ownership data was used. Each of the 70 seats was placed in a category by judgment from Delhi's residential geography, and the coding was not blind to the results. The same finding rebuilt from published figures alone, grouping seats by the male share of their removals and by eastern-plains surname share, gives a spread of 11.4 points against the housing table's 12.9. New Delhi, Sep 3 (PTI) The Delhi High Court on Thursday ruled that booth level agents of political parties cannot be held liable for false details in enumeration forms that cannot be verified during the Special Intensive Revision of electoral rolls.

<nh-chunk-delimit /> Justice Amit Bansal said booth level agents (BLAs) are liable only for verifiable information like the elector's photograph. &quot;In the opinion of this court, BLA can only be made liable in terms of Section 31 of the Representation of People Act for information that can be verified by the BLA, i.e., the photograph on the enumeration form matches with the identity of the elector,&quot; the judge said. Section 31 states that making false declarations with respect to the preparation, revision or correction of an electoral roll is punishable with imprisonment for a term which may extend to one year, or with fine, or with both. The judge passed the judgement on a petition by the Delhi Pradesh Congress Committee (DPCC) president Devender Yadav and the chairman of the DPCC's booth management committee. The petitioners challenged the mandate requiring BLAs of political parties to give a personal undertaking certifying they have personally verified all details in the enumeration forms. It was argued that since the information to be filled in the enumeration form is within the elector's exclusive knowledge and the BLA's role is limited to providing assistance, he could not be made to personally authenticate all such details. The Election Commission of India (ECI) informed the court that it permitted all registered political parties to appoint their own BLAs to participate in the process of SIR to dispel any impression of supporters of any specific party being deliberately left out by the booth level officers (BLOs) in a partisan manner. The requirement of BLAs furnishing undertaking while submitting applications and forms on behalf of the electors was part of ECI's standing instructions and the Manual of Electoral Rolls, 2023, it stated. In the judgement, the court observed that under the SIR framework, the responsibility for verification and undertaking rested with the BLOs, and therefore, there was no justification for requiring BLAs to furnish personal undertakings certifying the correctness of the particulars in the enumeration form. It added that although BLAs would have full responsibility for the forms of dead or shifted voters, as they are filled by them based on information gathered by them, they cannot be held liable for all the unverifiable information pertaining to other electors. &quot;The BLA cannot be made liable for all the information, which is contained in the Enumeration Form as there is no way a BLA could be in a position to verify the same. The said information would be exclusively within the knowledge of the concerned elector,&quot; the court said. The court also said that the copies of 2002 electoral roll and the final 2025 roll was available on the ECI website and can be downloaded or physically sought from the ECI. The petitioners would be free to apply for physical copies of the electoral rolls up till May 2026, based on which the SIR is being conducted, and subject to payment of requisite fees, the same would be supplied to the petitioners, it added. Senior advocate Sakal Bhushan, along with lawyers Sunil Kumar, Vasu Bhushan, Prateek Kumar Sinha and Nipun Bhushan appeared for the petitioner. According to the petitioner, neither the Representation of the People Act nor the Registration of Electors Rules contain any provision empowering the Election Commission to ask the representatives of political parties to give such an undertaking. &quot;The requirement of a personal undertaking from BLAs is directly contrary to the statutory scheme of verification prescribed under Section 23 of the Representation of the People Act, 1950, which mandates that the inclusion of any name in the electoral roll shall be made by the Electoral Registration Officer, and only after 'proper verification of facts in such manner as may be prescribed',&quot; the petition had said. &quot;The prescribed manner of verification under the Rules is to be conducted by statutory officers, not by private individuals or party representatives. MARGAO: The Election Commission of India organised a regional conference on Electoral Literacy Clubs (ELCs), ECINET and the polling process at Ravindra Bhavan, Margao, bringing together more than 1,000 Booth Level Officers (BLOs) from across Goa.

He described BLOs as the backbone of the electoral system and interacted with them to understand their experiences, challenges and best practices in voter registration, corrections in electoral rolls, address changes and the Special Intensive Revision (SIR).Kumar also highlighted the importance of ECINET, the Election Commission&apos;s digital platform that allows citizens to download electoral rolls and access various voter-related services.Commending Goa&apos;s performance during the Special Intensive Revision, Kumar said, &quot;Goa has the best SIR in the country,&quot; while appreciating the efforts of the state&apos;s election machinery and BLOs in maintaining accurate and inclusive electoral rolls.As part of the voter awareness initiative, a 2D animated film highlighting the election process, voter registration and citizen participation was screened during the programme.The conference assumes significance ahead of the Goa Legislative Assembly Elections 2027, with accurate electoral rolls, enrolment of eligible voters, awareness among first-time voters and grassroots-level preparedness emerging as key priorities.The programme was attended by Goa Chief Electoral Officer Dr Sanjay Goyal, IAS, Director General (Media) Ashish Goyal, Director General (IT) Seema Khanna, North Goa Collector Ankit Yadav, Kushawati Collector Gurudas Desai and South Goa Collector Egna Cleetus, along with officials of the Election Commission of India and BLOs from across the state.

Ranchi: Voter disenfranchisement threatens to spread to more states as Booth-level agents (BLAs) of the Bharatiya Janata Party (BJP) submit Form 7 applications in bulk, seeking to delete Muslim voters during the ongoing Special Intensive Revision (SIR) of electoral rolls in Jharkhand.

<nh-chunk-delimit />The BLAs submitted the forms to the respective booth-level officers (BLOs), but a face-off took place when the agents sought the BLOs&apos; signatures on the receiving documents.Following reports of misuse of Form 7 submissions in Gujarat, Uttar Pradesh, Uttarakhand, and Odisha, Jharkhand has now come under the scanner as an Indian Expressinvestigation unveiled that BJP’s BLAs themselves confessed to filing forms en masse targeting voters from the Muslim community.The Election Commission of India has clarified that a voter and a BLA can submit several Form 7s; however, if an individual submits more than five objections, the Electoral Registration Officer (ERO) is required to review the forms. Since the SIR began in 2025, Opposition parties have demanded that the ECI take concrete steps to address the misuse of Form 7, alleging it is being used as a “weapon of mass voter suppression” instead.The report, published on Wednesday, September 2, said that Booth-Level Officers of at least four booths in Jharkhand’s Godda district have complained to higher authorities about multiple Form 7s submitted by BJP agents, with most of them in an incorrect format and against Muslim voters.‘What if we are not considered Indian citizens?’In the Maheshtikri booth, eight out of the 25 voters mentioned in Form 7 said they have been a resident of the village since their childhood. Many said their names were included in the Jharkhand draft electoral roll published on August 5 and that their parents and grandparents were mapped to the 2003 electoral roll.Among those listed in the objection applications was 70-year-old Abdul Mannan Khan, who said his family has been living in the village for generations. &quot;This is our home and we are Jharkhandi too. So how can our names be deleted?&quot; he said. The local BLO told Khan that his name would not be deleted, but he remains anxious as his family fears losing access to welfare programmes. Mohammad Naushad, 50, told Indian Express that he was brought up in Maheshtikri and that his grandparents had been mapped in the 2003 electoral roll. He said he left to find work, but always made an effort to vote in Jharkhand. “What if our names are deleted and we do not get government benefits? What if we are not considered Indian citizens?&quot; Naushad said, echoing Khan.BLAs claim forms being sent by ex-BJP MLAApart from Maheshtikri, Pachua Kita, Lochni and Baghakol also recorded objections filed by the saffron party’s BLAs. According to the Express report, the BLAs confessed that the forms were coming from the BJP office. Another party agent reportedly said the forms were being sent by former BJP MLA of Godda district Amit Mandal, as suspected by the BLOs.BJP BLA Sanjeev Kumar claimed he had submitted the forms on the party&apos;s directions. “I was provided 25 such forms by the party. As per the party&apos;s direction, I took the forms, in which every column was already filled, to the BLO, but she refused to sign,” Kumar told PTI.Block Divisional Officer Sriman Marandi, serving as the ERO, confirmed he received complaints from the BLOs who alleged the BLAs were submitting Form 7s en masse without citing proper sources. He directed BLOs not to accept the forms “because we don’t know the source,” adding that the agents could have submitted the objections to him rather than submitting forms. The BDO also noted that the forms from all four booths were predominantly against the Muslim community. In one instance, when a booth-level officer questioned a BLA about the multiple objection applications, the agent reportedly “got confused” and burnt all the documents in front of him to remove evidence of any irregularity.The BLOs in the constituencies have maintained that they are willing to accept the applications, as long as the forms are credible.BJP’s cross complaintMeanwhile, the BJP has submitted a letter to the state’s additional CEO accusing the booth nine, Maheshtikri’s BLOs of not accepting Form 7s given by its BLAs.The party has repeatedly claimed that residents of Godda and Sahibganj include duplicate voter entries, individuals registered in two states, and voters from other states entirely.Rashtriya Janata Dal‘s Sanjay Prasad Yadav is the current MLA of Godda assembly constituency, defeating Mandal in the 2024 elections. Probe orderedJharkhand Chief Electoral Officer (CEO) K Ravi Kumar said he has sought a report in this regard from the district election officer (DEO).“BLAs can submit forms in bulk, and the BLOs cannot deny accepting them. However, the BLA has to submit a declaration that information provided in the form is true. We have to check if the BLA had submitted declaration or not,” Kumar told reporters here.The Election Commission published the draft electoral rolls in Jharkhand on Wednesday after deleting over 43.61 lakh names. The state had 2.64 crore electors before the enumeration exercise began.The EC has extended the deadline for filing claims and objections under the SIR of electoral rolls in the state to September 15, while the final publication of the revised voter list has been deferred to October 19, an official said.<hr></hr>
