COMMERCIAL COURTS' PENDENCY AND INFRASTRUCTURE DATA DEADLINE- SUPREME COURT

Case Name: Indian Commercial and Arbitration Bar Association (ICABA) vs.

Union of India & Ors.

While Dealing with the petition related to implementation of Commercial Court Act Justice K V Vishwanathan and Justice N Kotiswar Singh has directed all High Courts to furnish data on pending Commercial Disputes and also infrastructure available for Commercial Courts. The Court had earlier in 2023 asked Union to inform the Court regarding this. The Court has given a deadline to the Union to submit a status report in this regard up till April 15,2025.

MEDICAL BOARD DISABILITY ASSESSMENT IS RELIABLE- SUPREME COURT HELD IN MOTOR ACCIDENT COMPENSATION CASE

Case Name: Prakash Chand Sharma vs. Rambabu Saini & Anr.

Recently the Supreme Court overturned the Rajasthan High Court order in Motor Vehicle Compensation Act, where the High Court due to absence of testimony reduced 100% compensation to 50%. The Apex Court ruled that a disability certificate from the Medical Board must be regarded as Evidence.The victim in this case is in Comatose condition due to multiple injuries in collision. The Apex Court also extended the compensation from ₹19.3 lakh to ₹48.7 lakh.

SUPREME COURT HIGHLIGHTED RIGHTS OF FATHER AS NATURAL GUARDIAN

Case Name: Vivek Kumar Chaturvedi & Anr. vs. State of U.P. & Ors.

The Supreme Court while setting aside High Court judgement in the Child's Custody case, mentioned its legal right of father to have its child's Custody if there is no complaint or allegation of matrimonial dispute when mother was alive or allegations of abuse on wife or son. The Court ruled in favour of and also highlighted Father is Child's Natural Guardian and has stronger claim over his Child than maternal grandparents. Custody was transferred to Father while allowing visiting rights to grandparents.
