Case Name: Vishal Tiwari vs. Union of India & Ors.

On 15th Feb, a tragic stampede occurred in New Delhi Railway Station, when a sudden change in departure platform of a train going to Prayagraj.

Advocate Vishal Tiwari has filed a petition seeking a way to implement the "Managing Crowd at Events and Venues of Mass Gathering" Report published by National Disaster Management Authority in 2014. The Petitioner filed the plea in Supreme Court in this regard seeking an expert committee to prevent such incidents at railway stations, also urges implementation of the report and calls for safety corridors at railway stations such as wider platforms and escalators etc.

SUPREME COURT MODIFIES WOMEN'S RESERVATION RULES IN DELHI BAR ASSOCIATIONS

Case Name: Fozia Rahman vs. Bar Council of Delhi & Anr.

Recently while hearing an application on eligibility and reservation of women's seat in Delhi District Bar Association, the Supreme Court passed an order that out of 30% of Executive Committee reserved seats for Women's Lawyer in bar half should be filled by lawyers with over 10 years of practice experience. While this eligibility criteria is not applicable for the other half. The Election Commission will have discretion.

GRATUITY CAN BE FORFEITED FOR MISCONDUCT WITHOUT CRIMINAL CONVICTION: SC

Case Name: Western Coal Fields Ltd. v. Manohar Govinda Fulzele

The Supreme Court in a recent case regarding Payment under Gratuity Act, 1972 ruled that Gratuity can be forfeiture if an employee is found guilty of moral misconduct this does not require criminal conviction. They have also made it clear that disciplinary authorities can decide on the partial and full forfeiture of the Gratuity based on the severity of the conduct.
